Introduction

This Privacy Policy applies to the processing of personal data of all our users with regard to the products and/or services of Franky Amsterdam Jewellery B.V., having its registered office at (1017 DK) Amsterdam, at Keizersgracht 447A, registered in the Dutch Chamber of Commerce under registration number 86509373 (hereinafter: “Franky Amsterdam”). 

In this Privacy Policy we explain how the personal data is processed and for which purposes the data are being processed. By using the products and/or services of Franky Amsterdam and accepting this Privacy Policy, the following terms shall apply.

Disclosing personal data is not required 

A user shall at all times have the option whether or not to disclose personal data. However, for the use of a number of our products and/or services it is requested to disclose personal data to Franky Amsterdam. If the input of your details is required, Franky Amsterdam shall inform you which data is ‘necessary’ to be able to use the products and/or services and which data are ‘optional’.

Processing of personal data 

By using the products and/or services of Franky Amsterdam, we process personal data of our users. This data is collected for certain purposes based on a legitimate legal ground. These are the following categories of data, purposes and legal grounds.

This concerns name, address and email address. Furthermore, financial details, such as a bank account number, are being processed if a user purchases paid products and/or services of Franky Amsterdam, if such details are necessary for the payment of said products and/or services.

When placing an order: full name and address information, email address and financial information, such as a bank account number.

Cookies: If the user visits a website from our network, personal data such as the IP address will be processed.

The processing of personal data takes places for the following purposes:

a. Formation and execution of an agreement with a user;
b. Administrative processing; to offer and/or deliver the products and/or services as purchased by a user;
c. Invoicing; in case of paid products and/or services. Should payment fail, Franky Amsterdam may pass on the claim for collection to a debt collection company

In the aforementioned situations the full name, address, email address and bank account details and are necessary for the execution of the agreement.

d. to send user newsletters, offers, user information, service notices and/or other electronic messages that may be relevant for the user, in case the user has explicitly agreed thereto;

e. To make direct offers to user or for other promotional purposes, via social media and/or e-mail in case the user has explicitly agreed thereto. 

In the aforementioned situations the personal data, i.e. e-mail address, are provided optionally for which processing User provides permission.

f. To control, analyze, maintain, optimize and secure our products and/or services and to detect and deter misuse and/or fraud of our products and/or services;

g. To determinate strategic analyses and reports of our products and/or services; 

In aforementioned situation Franky Amsterdam has a legitimate interest to process personal data.

h. To build a profile of the user using the user's online browsing behavior. This allows us to tailored advertisements to the user's profile.

In the aforementioned cases, personal data, i.e. IP address are essential for the performance of the agreement. The user must give explicit consent to the processing of this.

The provided personal data shall solely be processed by Franky Amsterdam for the purpose of the execution of the products and/or services and, more specific, the express purpose for which the personal data is collected.

Data collected automatically

Apart from the use of cookies, Franky Amsterdam does not collect any data automatically.

Sensitive Personal Data

We do not process sensitive personal data.

Retention period

The personal data shall solely be stored during the period which shall be necessary for the execution of the purposes as set out above, unless applicable laws prescribe longer retention periods in which case the personal data shall be stored for the period as prescribed by the applicable laws.

Rights users

All our users have certain rights under the GDPR legislation to manage their own personal data:

• Right of access and information;
• Right of rectification;
• Right of erasure;
• Right to object the processing of his/her personal data;
• Right of data portability; and 
• Right of restriction of processing

In addition, a user may withdraw the consent he has given to the processing of his data at any time. Furthermore, a user has the right to complain about our data processing activities to a data protection authority.

Data obtained from third parties

Franky Amsterdam does not process personal data obtained from third parties.

Transfer to third parties

Only persons authorized by Franky Amsterdam for the security and/or processing and/or maintenance of IT-structure have access to personal data of users. 

If, for the purposes as set out in this Privacy Policy, we involved a controller, such as postal services and payment services, we closed an agreement to ensures that the controller offers sufficient assurance with regard to technical and organizational safety measures.

In case you discover a data breach, it is of utmost importance that we are informed. You may report this through info@frankyamsterdam.com. Your report and data will be treated confidentially.

Franky Amsterdam shall not provide personal data of its users to third parties unless set out in this Privacy Policy and/or unless this is necessary for the execution of its products and/or services, on the basis of a statutory provision or in case of an emergency if this is, in the reasonable opinion of Franky Amsterdam, in the interest of it users. This includes legitimate requests of authorities, summons or court orders, acts to investigate or prevent damages or fraud, or acts to guarantee the safety of our network and our products and/or Services.

Storage of personal data

The personal data processed by us will be stored exclusively in the Netherlands and will not exceed the borders of the EU. The GDPR thus applies to this stored personal data.

Security

Franky Amsterdam has taken adequate technical and organizational measures to secure the personal data of its users against loss or unlawful processing, amongst which (i) storage of personal data in a secured database with encrypted passwords and (ii) payment orders to Franky Amsterdam through secured payment systems.

We use functional and/or analytical and/or tracking cookies. A cookie consists of a small text file that is stored on the user's computer when the website is visited for the first time. The use of cookies is necessary for the technical functioning of the website and the ease of use of the user.
